Personal data processing policy and data protection system under the GDPR<\/strong><\/p>\n

 <\/u><\/strong><\/p>\n

The purpose of this policy is to demonstrate that the processing of personal data by the operator is carried out in  accordance with the currently applicable legislation, in particular Act 18\/2018 Coll. on the Protection of Personal Data (hereinafter referred to as “the new Personal Data Protection Act”) and Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”). The new legislation obliges the operator, considering the nature, scope, and purpose of the processing of personal data and the risks of varying likelihood and severity to the rights of the natural person, to take appropriate technical and organisational measures to ensure and demonstrate that the processing of personal data is carried out in accordance with the new legislation. The operator is obliged to update these measures as necessary. <\/p>\n

This document is the result of an assessment of the processing of personal data by the operator for the purposes of the legal standards governing the protection of personal data. By implementing standardised data protection based on the principles set out here, the risk of a data breach is minimised. <\/p>\n

LEGAL BASIS FOR PROCESSING PERSONAL DATA:<\/u><\/strong><\/p>\n

The legal basis for the processing of personal data by the operator concerning data subjects of all categories are the following provisions of the GDPR, or the new Personal Data Protection Act: <\/p>\n

a) processing is necessary for the performance of a contract<\/u><\/strong> to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract – pursuant to Section 13(1)(b) of the Personal Data Protection Act, or Art. 6(1)(b) of the GDPR. <\/p>\n

(orders, contracts for work, employment contracts, pre-contractual relationships, CVs….)<\/p>\n

b) Pursuant to Section 78(3) of the Personal Data Protection Act <\/b><\/u> an operator who is the employer of the data subject is entitled to provide their personal data or publish their personal data to the extent of title, first name, surname, job title, service rank, functional classification, personal employee number or employee ID, professional department, place of work, telephone number, fax number, workplace email address, and employer identification data, if necessary in connection with the performance of the data subject’s work, service, or functional duties. The provision or publication of personal data must not infringe upon the dignity, respect, and safety of the data subject. <\/p>\n

c) processing of personal data is necessary under a special regulation<\/u><\/strong> or an international treaty by which the Slovak Republic is bound – pursuant to Section 13(1)(c) of the Personal Data Protection Act, or Art. 6(1)(c) of the GDPR (Commercial Code, Labour Code, Health Insurance Act, Social Insurance Act, Income Tax Act….) <\/p>\n

d) processing is necessary for the purposes of the legitimate interests<\/u><\/strong> of the operator<\/u><\/strong> or a third party, except where such interests are overridden by the interests or rights of the data subject requiring the protection of personal data, especially if the data subject is a child – pursuant to Section 13(1)(f) of the Personal Data Protection Act, or Art. 6(1)(f) of the GDPR <\/p>\n

e) further processing of personal data for the purpose of archiving<\/u><\/strong>, for scientific purposes, for historical research purposes, or for statistical purposes, if it is in accordance with a special regulation and if appropriate safeguards for the protection of the data subject’s rights are maintained.<\/p>\n

DECLARATION:<\/u><\/strong><\/p>\n

We declare that, as the operator of your personal data, we comply with all legal obligations required by applicable legislation, in particular the Personal Data Protection Act and the GDPR, and therefore that:<\/p>\n

  • we will process your personal data only on the basis of a valid legal reason described above.<\/li>\n
  • we hereby fulfill our information obligation towards data subjects pursuant to Article 13 of the GDPR<\/li>\n

        We process personal data that you entrust to us for the following purposes:<\/p>\n

        • Contractual\/pre-contractual partners and customers of the operator<\/strong>:<\/li>\n<\/ul>\n

           <\/strong><\/p>\n

          The company KAVAZ s.r.o.<\/strong> is the operator of personal data obtained in connection with business activities concerning its contractual and pre-contractual partners.<\/p>\n

          Your personal data \u2013 business name, postal address, email address, telephone number, names and surnames of contact persons, Company ID (I\u010cO), Tax ID (DI\u010c), VAT ID (I\u010c DPH)<\/strong> are processed for the purpose of:<\/p>\n

          • implementing contractually agreed cooperation<\/li>\n
          • processing orders, delivery of ordered products, and all related matters<\/li>\n
          • processing inquiries for the delivery of products and services, their acceptance, and all related matters<\/li>\n
          • identification of the contracting party<\/li>\n
          • provision of the agreed service\/delivery of the ordered goods<\/li>\n<\/ul>\n

            • Employees:<\/strong>\n

              • The operator processes the personal data of its employees exclusively for the purposes of employment relationships and other legal relationships arising from labour law and social security law.<\/li>\n
              • The operator processes personal data necessary for the payment of wages and personnel management based on an employment relationship or processing based on agreements for work performed outside of an employment relationship<\/li>\n
              • A further purpose is the fulfillment of the employer’s obligations related to the employment relationship, civil service relationship, or similar relationship (e.g., based on agreements for work performed outside of an employment relationship) including pre-contractual relationships<\/li>\n
              • Also to ensure the identification of its employee in employment contracts<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                HOW LONG WE WILL COLLECT YOUR PERSONAL DATA:<\/u><\/strong><\/p>\n

                  \n
                • The operator guarantees that personal data provided by the data subject in the relevant contract or in another way will be processed in information systems in accordance with the principle of storage minimisation, and in the event that the purpose of processing ceases to exist, the operator guarantees to delete the personal data. In the event that said personal data is processed for a purpose other than that specified above in this article, the data subject will be informed of this purpose as well as the legal basis for such processing prior to such processing. <\/li>\n
                • The operator guarantees that personal data of employees for the purposes specified in this policy will be processed for a maximum of the duration of the employment relationship, or if required by any of the above-mentioned regulations, for the period specified in that legal regulation.<\/li>\n<\/ul>\n

                  SECURITY AND PROTECTION OF PERSONAL DATA:<\/u><\/strong><\/p>\n

                  We protect personal data to the maximum extent possible. We protect it as if it were our own. We have implemented all possible technical and organisational measures to prevent the misuse, damage, or destruction of your personal data. <\/p>\n

                  TRANSFER OF PERSONAL DATA TO THIRD PARTIES (PROCESSORS, RECIPIENTS):<\/u><\/strong><\/p>\n

                  Authorized persons appointed by the operator, who are bound by confidentiality and trained in the field of processing security, have access to your personal data.<\/p>\n

                  We handle most processing operations ourselves and do not need 3rd parties for them.
                  To ensure certain specific processing operations that we cannot provide on our own, we use the services of processors who specialise in the given processing and are bound by a processing agreement in accordance with the GDPR. <\/p>\n

                  • Occupational health and safety (BOZP) service provider<\/li>\n
                  • Accounting services provider<\/li>\n
                  • Medical provision for fitness-for-work assessment<\/li>\n<\/ul>\n

                    TRANSFER OF DATA OUTSIDE THE EUROPEAN UNION:<\/u><\/strong><\/p>\n

                    We process data exclusively within the European Union or in countries that ensure a level of protection based on a decision of the European Commission.<\/p>\n

                    YOUR RIGHTS IN CONNECTION WITH PERSONAL DATA PROTECTION:<\/u><\/strong><\/p>\n

                    You have several rights in connection with personal data protection. If you wish to exercise any of these rights, please contact us via the email address provided above. <\/p>\n

                    You have the right to information<\/strong>, which is already fulfilled by this personal data processing policy. \u2013 information obligation <\/p>\n

                    Thanks to the right of access<\/strong>, you can request us at any time and we will provide evidence within 30 days of what personal data of yours we process and why.<\/p>\n

                    If something changes for you or if you notice any of your personal data is outdated or incomplete, you have the right to supplement and change personal data<\/strong>.<\/p>\n

                    You can exercise the right to restriction of processing<\/strong> if you believe that we are processing inaccurate data, if you think we are processing data unlawfully but do not want to delete all data, or if you object to the processing.<\/p>\n

                    You can restrict<\/strong> the scope of personal data or the purposes of processing.<\/p>\n

                    Right to erasure (to be forgotten):<\/strong> Your further right is the right to erasure, in the event that there is no legal basis that authorises us or a legal obligation that commands us to process your personal data. In such a case, we will delete all your personal data from our system, as well as from the systems of all sub-processors and backups within the legally prescribed period. <\/p>\n

                    Complaint to the Office for Personal Data Protection: <\/strong>If you feel that we are not handling your data in accordance with the law, you have the right to contact the Office for Personal Data Protection with your complaint at any time. We would be very pleased if you first inform us of this suspicion so that we can do something about it and correct any potential error. <\/p>\n

                    CONFIDENTIALITY<\/u><\/strong><\/p>\n

                    We would like to assure you that as the operator, and also our employees, collaborators, and processors who will process your personal data, are obliged to maintain confidentiality regarding personal data, the disclosure of which would jeopardise the security of your personal data. This confidentiality continues even after the termination of relationships with us. Your personal data will not be provided to a third party without your consent. <\/p>\n
